These Terms and Conditions (“Terms”) govern your access to and use of our website, online forms, products, services, warranty registration, and Referral Program.
“You” and “your” refer to any website visitor, customer, prospective customer, or Referral Program participant.
By accessing our website, submitting information, requesting a quote, registering a warranty, or participating in the Referral Program, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use the website or its services.
Any signed purchase agreement, build sheet, invoice, repair authorization, rental agreement, financing agreement, or written warranty may contain additional terms. If a signed agreement conflicts with these website Terms, the signed agreement controls for that transaction.
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase, rent, finance, or take delivery of a trailer or participate in the Referral Program.
You agree to provide complete, accurate, and current information when using our website or communicating with HDTS.
We make reasonable efforts to provide accurate information. However, website content may contain errors, omissions, outdated information, or differences involving:

Website information is provided for general informational and promotional purposes and does not constitute a binding offer or guarantee.
Final pricing, specifications, options, components, delivery terms, and other transaction details will be stated in the applicable quote, purchase agreement, build sheet, or invoice.
Product photographs and videos may show optional equipment, accessories, customizations, upgraded components, or configurations that are not included in the base price.
Colors and finishes may appear differently due to lighting, photography, screen settings, material variations, and manufacturing processes.
Minor differences in color, finish, weld appearance, material texture, component placement, or measurements may occur and do not necessarily constitute a defect.
HDTS may make reasonable component or material substitutions when the original component is unavailable, provided the substitute offers substantially comparable function and quality.
Submitting a quote request or contacting HDTS does not create a binding purchase agreement.
Unless otherwise stated in writing, quotes:
Are based on information available when prepared.
Are subject to material and component availability.
May change because of material, labor, freight, supplier, or regulatory costs.
Do not guarantee financing approval.
Do not reserve production space or inventory.
Expire on the date shown on the quote.
Prices may not include sales tax, title fees, registration fees, tag fees, delivery, financing charges, optional equipment, or other government charges unless expressly stated.
HDTS may reject or cancel an order because of pricing or specification errors, payment problems, product unavailability, safety concerns, suspected fraud, production limitations, legal requirements, or other legitimate business reasons.
Custom-order requirements, deposits, payments, cancellations, changes, and refunds are governed by the applicable signed purchase agreement and invoice.
Customers are responsible for reviewing and approving all trailer specifications, dimensions, weight ratings, components, colors, accessories, and options before production begins.
HDTS is not responsible for an error contained in a specification approved by the customer unless HDTS failed to manufacture the trailer according to the approved specification.
Changes requested after approval may increase the price, delay completion, require additional payment, or be declined if production has progressed too far.
Production, completion, pickup, and delivery dates are estimates unless expressly guaranteed in a signed agreement.
Schedules may be affected by material shortages, supplier delays, labor availability, equipment failure, weather, transportation issues, design changes, customer-requested changes, payment delays, inspections, government actions, and other circumstances outside our reasonable control.
HDTS will communicate significant delays when reasonably practical. We are not responsible for lost income, missed work, rental expenses, or other indirect losses resulting from an estimated production or delivery date, except where applicable law provides otherwise.
Customers are responsible for confirming that a trailer is appropriate for their intended use.
Trailer owners and operators are responsible for:
Using a properly rated tow vehicle, hitch, and coupler.
Confirming towing, payload, axle, tire, and hitch capacities.
Properly connecting safety chains and breakaway equipment.
Inspecting tires, wheels, lights, brakes, cargo securement, and connections before use.
Loading and distributing cargo properly.
Avoiding overloading.
Performing required inspection and maintenance.
Following manufacturer instructions.
Operating the trailer safely and legally.
HDTS is not responsible for damage or injury caused by overloading, improper loading, inadequate cargo securement, improper towing, accidents, misuse, neglected maintenance, unauthorized modifications, or unsafe operation.
HDTS provides a limited two-year warranty to the original owner covering qualifying defects in materials and workmanship involving structural components manufactured by HDTS, including qualifying frame, deck-support, tongue, ramp, and HDTS-created weldments.
The warranty begins on the original delivery date and is not transferable.
Components manufactured or supplied by third parties—including jacks, couplers, hinges, lights, brakes, axles, tires, wheels, batteries, hydraulic equipment, and breakaway kits—are subject to the applicable component manufacturer’s warranty, if any, and are not manufactured by HDTS.
The HDTS warranty does not cover damage or failure caused by:
Overloading or improper loading
Misuse or abuse
Accidents or collisions
Improper towing
Normal wear and tear
Rust, corrosion, fading, or cosmetic deterioration
Road hazards or environmental exposure
Lack of maintenance
Unauthorized alterations
Improperly performed repairs
Continued use after a defect or unsafe condition becomes apparent
Repair or service performed by another provider does not automatically cancel the entire warranty. However, coverage may be denied to the extent that damage or failure was caused or made worse by an improper repair, unsuitable component, or unauthorized modification.
Warranty claims must be reported promptly. HDTS must be given a reasonable opportunity to inspect the trailer before repairs are authorized.
Third-party repair expenses will not be reimbursed unless HDTS approved the repair in writing beforehand.
For a covered claim, HDTS may inspect, repair, or replace the qualifying defective component. Warranty recovery for a replacement component will not exceed the original cost of that component as installed and sold by HDTS, except where applicable law requires otherwise.

The HDTS Referral Program allows eligible participants to earn $100 for each qualifying referral, up to five qualifying referrals and a maximum total reward of $500.
Participants must be at least 18 years old. The program is void where prohibited.
A referral qualifies only when:
It is submitted through the official HDTS referral form or another approved method.
The referred person is a new prospective customer who was not already communicating with HDTS, requesting a quote, listed in our records, or referred by another participant.
The referral is submitted before the prospective customer contacts HDTS, requests a quote, or pays a deposit.
The referred customer purchases a new trailer directly from HDTS.
The trailer is paid for in full with cleared funds.
The trailer is successfully delivered.
The purchase is not canceled, refunded, disputed, reversed, or charged back.
The participant complies with these Terms.
Only one participant may receive a reward for each customer. If multiple people refer the same customer, the first complete and verifiable referral recorded by HDTS will be considered.
Self-referrals, duplicate referrals, fabricated referrals, existing customers, manipulation, fraud, and referrals submitted after the customer contacts HDTS are not eligible.
Only one reward is available per referred customer, regardless of how many trailers, accessories, or services that customer purchases, unless HDTS agrees otherwise in writing.
A reward is not earned when the referral is submitted, when a quote is given, or when a deposit is paid. It becomes eligible only after the trailer has been paid in full and delivered.
Payment processing time may vary. HDTS will determine the available payment method and may require identification, payment information, or tax documentation. Participants are responsible for taxes associated with referral rewards.
By submitting a referral, the participant confirms that the referred person gave permission for their information to be shared with HDTS and for HDTS to contact them. Purchased contact lists, spam, automated messages, and unlawfully obtained information are prohibited.
Participants may recommend HDTS but may not negotiate sales, provide official quotes, collect money, guarantee pricing or delivery, or represent themselves as an HDTS employee, salesperson, broker, or agent.
When promoting HDTS publicly or online, participants must disclose that they may receive a reward. A suitable disclosure is:
“I may receive $100 if you purchase a trailer through my referral.”
HDTS may verify all referral information. We may reject a referral, delay payment, deny or revoke a reward, or disqualify a participant when we reasonably determine that the program requirements were not satisfied, information was inaccurate, the referral was duplicated, fraud or abuse occurred, the underlying purchase became ineligible, or paying the reward may violate applicable law.
HDTS may modify, suspend, or terminate the Referral Program at any time. Referrals that completely qualified before termination will generally be honored unless they involved fraud, abuse, an ineligible transaction, or a legal concern.
Participation does not create an employment, agency, brokerage, partnership, sales-representative, or independent-contractor relationship with HDTS.
Personal information submitted through the website is governed by our Privacy Policy.
By submitting a form or contacting HDTS, you authorize us to respond using the telephone number, email address, or other contact information you provide.
Consent to receive optional marketing communications is not a condition of purchasing a product or service where prohibited by law.

To the maximum extent permitted by law, HDTS and its owners, employees, agents, contractors, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the website, online services, or Referral Program, including lost profits, lost opportunities, lost data, or business interruption.
To the maximum extent permitted by law, total HDTS liability arising exclusively from the website, online services, or Referral Program will not exceed the greater of $100 or the referral rewards paid or payable to the participant during the preceding 12 months.
This limitation does not apply where liability cannot legally be limited or to applicable liability resulting from willful misconduct or gross negligence.
Trailer purchases, repairs, rentals, and warranty claims may also be governed by their applicable signed agreements and written warranties.
To the extent permitted by law, you agree to indemnify and hold harmless HDTS and its owners, employees, agents, contractors, and affiliates from third-party claims, losses, liabilities, and reasonable legal expenses arising from:
Your violation of these Terms.
Your unlawful use of the website.
False information or content you submit.
Your infringement of another person’s rights.
Information you share without permission.
Unlawful referral or marketing activities.
Misuse, overloading, modification, or unsafe operation of a trailer.
This provision does not require indemnification for losses caused solely by HDTS where such indemnification is prohibited by law.
HDTS may update these Terms by posting a revised version and changing the “Last Updated” date.
Changes become effective when posted unless otherwise stated. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.
Changes to these website Terms will not automatically modify a previously signed agreement or written warranty.
These Terms are governed by the laws of the State of Florida.
Any legal proceeding arising specifically from these Terms, the website, or the Referral Program must be brought in a court of competent jurisdiction located in Polk County, Florida, unless applicable law requires otherwise.
Nothing in these Terms waives any consumer right or remedy that cannot legally be waived.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.
A failure by HDTS to enforce a provision does not waive our right to enforce it later.
